DPIIT Startup Recognition and Trademark Benefits for Indian Founders

The Indian government has introduced significant incentives for startups through the Startup India Initiative, administered by the Department for Promotion of Industry and Internal Trade (DPIIT). Among the most valuable benefits for new businesses is a 50% reduction in trademark filing fees and access to expedited examination — benefits that can dramatically reduce the cost and timeline of securing trademark protection.

This guide explains the DPIIT recognition process, the specific trademark benefits available, and how to claim these benefits when filing your trademark application with the Indian Trade Marks Registry.

Pro tip: Before you file, check whether your brand name is available with our free trademark check — it's free and takes less than a minute. Combine that with DPIIT fee savings for maximum value.

    What Is DPIIT Startup Recognition?

DPIIT recognition is a formal certification granted by the Indian government to entities that meet the definition of a "startup" under the Startup India Initiative. Once recognized, startups gain access to a range of benefits across taxation, funding, compliance, and intellectual property.

    Eligibility Criteria

To qualify for DPIIT recognition, your entity must meet all of the following criteria:

    1. Age of entity — The entity has been incorporated or registered for not more than 10 years from the date of incorporation
    2. Annual turnover — The entity's turnover has not exceeded ₹100 crore (~$12 million USD) in any financial year since incorporation
    3. Innovation and scalability — The entity is working towards innovation, development, or improvement of products, processes, or services, OR it has a scalable business model with high potential for employment generation or wealth creation
    4. Not formed by splitting or reconstruction — The entity must not have been formed by splitting up or reconstruction of an existing business

    Eligible Entity Types

The following entity types can apply for DPIIT recognition:

    • Private Limited Company (registered under the Companies Act, 2013)
    • Registered Partnership Firm (under the Indian Partnership Act, 1932)
    • Limited Liability Partnership (under the LLP Act, 2008)

Note: Sole proprietorships are not eligible for DPIIT startup recognition.

How to Apply for DPIIT Recognition

The application process is entirely online through the Startup India portal:

    1. Register on the Startup India portal with your business details
    2. Upload documents including:

    - Certificate of Incorporation or Registration

    - A brief description of your business and its innovative aspects

    - Supporting documents (pitch deck, patents, awards, etc.)

    1. Self-certify that your entity meets the eligibility criteria
    2. Submit the application for review

The review process typically takes 2–5 working days. Once approved, you receive a DPIIT Recognition Certificate with a unique recognition number.

    Trademark Benefits for DPIIT-Recognized Startups

    1. 50% Fee Reduction

The most immediate benefit is a 50% reduction in government fees for trademark applications. Under the Trade Marks Rules, 2017:

Applicant Type Fee per Class (E-filing)
    Standard applicant ₹9,000 (~$108 USD)
    DPIIT-recognized startup ₹4,500 (~$54 USD)
    Individual applicant ₹4,500 (~$54 USD)

The reduced fee of ₹4,500 per class applies to all trademark-related filings, including:

    2. Expedited Examination (Rule 24C)

DPIIT-recognized startups can request expedited examination of their trademark applications under Rule 24C of the Trade Marks Rules, 2017. Under standard examination, an application may take 1–3 months to receive an Examination Report. Under expedited examination, the timeline can be significantly reduced.

    To request expedited examination:

    1. File Form TM-M with the prescribed fee
    2. Include your DPIIT Recognition Certificate number
    3. The Registry will prioritize your application for examination

Note: Expedited examination does not guarantee faster registration — it only accelerates the examination phase. If objections are raised, the response timelines remain the same.

    3. IPR Facilitators

The Startup India Initiative provides access to IPR Facilitators — registered patent and trademark agents who provide pro bono or subsidized services to DPIIT-recognized startups. These facilitators can assist with:

    • Trademark search and filing
    • Responding to examination reports
    • Patent applications
    • IP strategy and portfolio management

A list of registered facilitators is available on the Startup India portal.

How to Claim DPIIT Benefits in Your Trademark Application

When filing your trademark application (Form TM-A) on the IP India online portal at ipindiaonline.gov.in, follow these steps to claim the startup fee reduction:

    1. Select applicant type — Choose "Startup" as your applicant category
    2. Enter DPIIT Recognition Number — Provide the recognition number from your DPIIT certificate
    3. Upload DPIIT Certificate — Attach a copy of your DPIIT Recognition Certificate
    4. Pay reduced fee — The system will automatically calculate the reduced fee of ₹4,500 per class

Common Mistakes When Claiming DPIIT Benefits

    • Not selecting "Startup" as applicant type — If you select "Company" or "LLP" without specifying startup status, the full fee will be charged
    • Expired recognition — Ensure your DPIIT recognition is still valid (recognition is valid for the startup's eligible period)
    • Missing certificate upload — The Registry may issue a deficiency notice if the DPIIT certificate is not attached

Can Foreign Startups Claim DPIIT Benefits?

DPIIT recognition is available only to entities incorporated or registered in India. Foreign companies cannot directly obtain DPIIT recognition.

However, if a foreign founder has incorporated an Indian subsidiary (e.g., a Private Limited Company registered under the Companies Act, 2013), that Indian entity can apply for DPIIT recognition and claim the startup benefits for its trademark filings.

    Trademark Strategy for Indian Startups

As a DPIIT-recognized startup, consider the following trademark strategy:
