United StatesUSPTO

Filing from outside the US? The USPTO requires a US attorney — we are yours.

Under 37 C.F.R. § 2.11(a), every foreign-domiciled trademark owner must keep a US-licensed attorney on record at all times. Our annual retainer appoints one as your attorney of record — monitoring deadlines and answering the USPTO on your behalf.

    • Licensed US attorney formally listed as your USPTO attorney of record
    • All USPTO correspondence and Office Actions received and reviewed for you
    • Maintenance & renewal deadlines monitored and actioned proactively

$120.00/year per trademark, billed annually (regular $144.00/year). GTC clients: the retainer becomes mandatory 1 year after registration or transfer.

    Who this service is for

Four trademark owners — all needing attorney coverage.

Whether the USPTO requires it of you or you simply want professional oversight, the retainer keeps a licensed US attorney on your file at all times.

    Legal requirement

    Foreign-domiciled owners

Under 37 C.F.R. § 2.11(a), owners domiciled outside the US are legally required to have a US-licensed attorney at all times. Non-compliance risks abandonment.

    GTC client — renewal required

    GTC filed or represented

If GTC filed your application or took over your representation, the retainer becomes mandatory 1 year after registration (or 1 year after GTC assumed representation). Missing this deadline removes your attorney representation.

    Pending or registered

    Changing your attorney

Filed pro se or with a prior attorney? We file a Revocation of Prior Power of Attorney (USPTO Form PTO/TM/80). No permission from your previous attorney is needed.

    1+ year after registration

    Post-registration coverage

Your trademark is registered and past the first year. Get continuous attorney oversight — deadline monitoring, correspondence handling, and filing discounts.

    Important notice

    For GTC clients

If your trademark was filed by GTC, or if GTC took over your representation at any stage, this retainer becomes mandatory one year after your registration date (or one year after GTC took over your representation, whichever applies).

What happens if you don't subscribe before that deadline?

    • GTC is required to file a Withdrawal of Attorney with the USPTO
    • You lose all monitoring, correspondence handling, and retainer discounts
    • For foreign-domiciled owners, there is no longer a US attorney on file — putting your registration at immediate risk of abandonment under 37 C.F.R. § 2.11(a)

    Your attorney of record

"When I'm your attorney of record, every Office Action the USPTO sends comes directly to my desk. I review it the day it arrives, assess the risk, and notify you with a plain-English summary — not legalese. Most of my clients never see a letter from the USPTO unless there's something they need to decide."

    US attorney representation FAQ

    Common questions

Yes. If your trademark application was filed by Global Trademark Company, or if you transferred attorney representation to GTC at any stage during prosecution or after registration, the annual retainer becomes a mandatory requirement one year after your registration date — or one year after GTC assumed representation, whichever date is later. Before that anniversary, we will contact you in advance with a reminder and renewal link. If the retainer is not subscribed by the deadline, GTC is required to file a Withdrawal of Attorney with the USPTO. This means: (1) you lose all monitoring, correspondence handling, and retainer discounts; (2) no US attorney will be on record for your trademark; and (3) for foreign-domiciled owners, this creates an immediate compliance breach under 37 C.F.R. § 2.11(a) that puts your registration at risk of abandonment. Enrolling before your deadline keeps your coverage uninterrupted.
