    The trademark filing guarantee.

    If we clear your mark and the trademark office still refuses it, we waive our professional fee and file one new application. Here is exactly how that works, in plain language.

    This Guarantee forms part of the Terms of Service of Global Trademark Company LLC ("GTC", "we", "us") and is read together with our Refund & Credit Policy. It is a commitment to do more work, not a promise about what the trademark office will decide. It applies to every new trademark application we file, in any jurisdiction. By engaging us for a new trademark filing, you agree to these terms.

    1. The short version

    • If we give you a clear-to-file read and the trademark office refuses your application, we waive our professional fee and file one new application for you.
    • This is free re-work, not a cash refund. It sits on top of our Refund Policy, it does not change it.
    • The trademark office's government fee is paid at cost and is not covered. Government fees are never refundable.
    • It does not cover third-party oppositions, or problems caused by inaccurate information or a missed deadline on your side.
    • We cannot guarantee registration. The trademark office decides that, not us.

    2. When the guarantee applies

    All of the following must be true:

    • We ran a clearance search and gave you a written read that your mark was clear to file.
    • You instructed GTC to file the application, and we filed it with the trademark office.
    • The trademark office refused the application on grounds we assessed in that clearance read.
    • You claim within 6 months of the final refusal.

    In other words, the guarantee covers the case where we told you the path looked clear and it still did not work out. Where we flagged a risk before filing and you chose to file anyway, the guarantee does not apply to that risk, because the call was made with eyes open.

    3. What it covers

    When the conditions in Section 2 are met, we will:

    • Waive our professional fee for one new application for the same mark and broadly the same goods and services.
    • Re-run a clearance read and adjust the strategy in light of the refusal, so the new filing has the best chance we can give it.
    • Prepare and file that new application with the trademark office.

    The guarantee is limited to one waived-fee refile per original application. A refusal of the second application is not covered by a further free refile, though we will of course advise you on your options.

    4. What it does not cover

    • Government fees. The trademark office's official fee for the new application is paid at cost and is your responsibility. Government fees are never refundable, in line with our Refund Policy.
    • Third-party oppositions. If your published mark is opposed by another party, that is a separate proceeding we quote for, not a refusal covered by this guarantee.
    • Risks we flagged before filing. If we advised that a ground of refusal was likely and you chose to proceed, a refusal on that ground is not covered.
    • Issues caused on your side. Inaccurate or incomplete information, a change to your mark or goods after filing, abandonment, or a missed deadline where you chose not to instruct us to respond.
    • A different mark. The free refile is for the same mark. A new brand name is a new matter.

    5. We do not guarantee registration

    This is important, so we will say it plainly. The trademark office examines and decides every application. No law firm controls that decision, and we do not promise it. What we promise is the work: a careful clearance read, a properly prepared filing, and, if a mark we cleared is refused, the professional work to file again at no professional-fee charge.

    We sell work, not outcomes. The guarantee is our way of standing behind the quality of that work, not a claim about a result the trademark office alone can deliver.

    6. How this relates to our Refund Policy

    Our Refund & Credit Policy explains that an IP office's decision is not a refund trigger, and that we do not issue cash refunds for the natural outcomes of examination. This Guarantee does not change that.

    Instead of money back, the guarantee gives you something we think is more useful: more work. You do not get a refund of the first filing, you get a second filing with our professional fee waived. The two documents fit together, and where they address the same point, the Terms of Service govern.

    7. How to claim, and questions

    If your trademark application is refused, reply to your matter thread or email support@globaltrademarkcompany.com with your application number and the refusal notice. We will confirm whether the guarantee applies under Section 2 and, if it does, start the free refile.

    Questions about whether your matter qualifies are welcome before you file, not just after. We would rather set expectations clearly up front. We may update these terms from time to time; the version in force on the day you engage us for a filing is the version that applies to that filing.
