What is a US trademark renewal?
A combined Section 8 & 9 filing required every 10 years to maintain your US registration.
- Section 8 proves continued use; Section 9 renews the registration
- Without renewal, your registration is cancelled permanently
- First due between years 9-10 after registration, then every 10 years
Section 8: Declaration of Continued Use
A sworn statement that you are still using the mark in commerce, filed with a current specimen.
- Required at years 5-6 and with every 10-year renewal
- Must include a specimen showing current commercial use
- Filed under 15 U.S.C. § 1058 (Section 8 of the Lanham Act)
Section 9: Application for Renewal
The actual renewal request extending your registration for another 10 years.
- Always filed together with Section 8 at the 10-year mark
- Filed under 15 U.S.C. § 1059 (Section 9 of the Lanham Act)
- Without it, your registration expires even if Section 8 is filed
Section 15: Declaration of Incontestability
Optional but recommended filing between years 5-6 that strengthens your legal position.
- Makes registration conclusive evidence of your right to use the mark
- Limits grounds for cancellation by third parties
- Requires 5 consecutive years of continuous commercial use
