    How it works

Three steps to a clean US renewal.

    1

    Send your registration details

Your USPTO registration number, the classes you still use, and your specimen if ready. An attorney confirms your §8 or §8 & §9 milestone before any work — or payment — begins.

    2

    We prepare and review

We draft the Section 8 declaration and Section 9 renewal, review your specimen, and send a flat-fee quote with the USPTO fee at cost.

    3

    Filed, then diarised

US-licensed attorneys file with the USPTO — within 3 business days on a direct order — and calendar your next 10-year renewal so nothing lapses.

    What you need to know

The §8 & §9 filings that keep your mark alive.

The windows, the specimen requirements, and the lapse that ends a USPTO registration for good.

What is a US trademark renewal?

A combined Section 8 & 9 filing required every 10 years to maintain your US registration.

    • Section 8 proves continued use; Section 9 renews the registration
    • Without renewal, your registration is cancelled permanently
    • First due between years 9-10 after registration, then every 10 years

Section 8: Declaration of Continued Use

A sworn statement that you are still using the mark in commerce, filed with a current specimen.

    • Required at years 5-6 and with every 10-year renewal
    • Must include a specimen showing current commercial use
    • Filed under 15 U.S.C. § 1058 (Section 8 of the Lanham Act)

    Section 9: Application for Renewal

The actual renewal request extending your registration for another 10 years.

    • Always filed together with Section 8 at the 10-year mark
    • Filed under 15 U.S.C. § 1059 (Section 9 of the Lanham Act)
    • Without it, your registration expires even if Section 8 is filed

    Section 15: Declaration of Incontestability

Optional but recommended filing between years 5-6 that strengthens your legal position.

    • Makes registration conclusive evidence of your right to use the mark
    • Limits grounds for cancellation by third parties
    • Requires 5 consecutive years of continuous commercial use

    Renewal deadlines & grace period

Filing windows and the consequences of missing them.

    • Section 8 only: between years 5-6 after registration
    • Section 8 & 9: between years 9-10, then every 10 years
    • 6-month grace period with $100/class surcharge per section
    • After the grace period: registration cancelled permanently

    Specimen requirements for renewal

What the USPTO accepts as proof of continued use.

    • Goods: labels, packaging, product photos, e-commerce screenshots
    • Services: website, advertising, brochures showing the mark in use
    • Must show current use (not historical)
    • Mock-ups and digitally altered images are NOT accepted

    What it costs

A flat fee, USPTO fees at cost.

Exactly what a US trademark renewal costs. Our service fee is flat; the USPTO's own government fee is whatever the office charges, passed through at cost.

    Step by step

From registration number to renewal, on time.

Two ways to start: Submit Inquiry for a personalised quote first (5-7 business days), or Direct Order to pay now for priority processing — filed within 3 business days. Either way, an attorney confirms your §8/§9 milestone before any work begins.

    1. Step 1

      Send your registration details

Tell us your USPTO registration number, the classes you still use, and any upcoming deadline. Upload your specimen of use if you have it ready.

    2. Step 2

      An attorney reviews your registration

We verify your registration status, identify whether you're at the §8 (years 5-6) or §8 & §9 (10-year) milestone, and confirm exactly what's required — including which classes to keep.

    3. Step 3

      Quote & secure payment

You get a transparent quote covering our service fee and the USPTO government fee. Submit Inquiry sends a personalised invoice (5-7 business days); Direct Order lets you pay now for priority processing.

    4. Step 4

Prepared & filed with the USPTO

Our US-licensed attorneys prepare and file your Section 8 & 9 declarations. With a Direct Order, filing is completed within 3 business days of receiving your specimen.

    5. Step 5

      Confirmation & next deadline calendared

Your renewal is filed and you receive confirmation and the updated registration certificate. We calendar your next 10-year renewal date so you never scramble again.
