    What is trademark renewal?

    Every trademark registration has a limited duration and must be renewed to keep protection alive.

    • Most registrations last 10 years from filing or registration
    • Renewal keeps your exclusive rights in force indefinitely
    • Called renewal, re-registration, continuation, or prolongation by jurisdiction

    Renewal deadlines by jurisdiction

    Each office runs its own renewal schedule and requirements.

    • US (USPTO): Section 8 at years 5-6; Section 8/9 at 9-10, then every 10 years
    • EU (EUIPO): every 10 years from the filing date
    • UK (UKIPO): every 10 years from the filing date
    • Canada (CIPO): every 10 years (was 15 pre-2019)
    • India / China / Japan / Australia: every 10 years

    Proof-of-use requirements

    Some jurisdictions require evidence that you're actually using the mark.

    • US: Declaration of Use with specimens at years 5-6 and every renewal
    • EU, UK, Canada, Japan: none at renewal, but marks can be challenged for non-use separately
    • Philippines: Declaration of Actual Use required at year 5 and every renewal

    Grace periods and late fees

    Most offices offer a grace period with surcharges — but filing on time is always cheaper.

    • USPTO: 6-month grace period, +$100/class surcharge
    • EUIPO: 6-month grace period, +25% surcharge
    • UKIPO: 6-month renewal period, then a 6-month restoration period
    • After grace-period expiry, most registrations cannot be restored

    Madrid Protocol renewals

    International registrations under the Madrid System renew centrally through WIPO.

    • A single renewal through WIPO covers all designated countries
    • Due every 10 years from the international registration date
    • You can selectively let specific country designations lapse

    What happens if you don't renew?

    Failure to renew has serious, often irreversible consequences.

    • The registration is cancelled — your exclusive rights are lost
    • You must file a new application from scratch
    • You lose your original priority date
    • Another party may have filed for the same or similar mark in the meantime
