The GTC service fee starts at $100 for most jurisdictions, $180 for a US Section 8 & 9 renewal, and $120 for an EUIPO renewal. On top of that, the office's own renewal fee is passed through at cost. The USPTO charges per class, the EUIPO charges a flat fee, and other offices vary. We itemize the service fee and government fee in your quote before any work begins.
Trademark renewal, also called re-registration, continuation, or prolongation depending on the jurisdiction, keeps your registration in force beyond its initial term. That term is typically 10 years. Without renewal, your registration lapses and your exclusive rights are lost.
US trademarks require a Declaration of Use (Section 8) between years 5-6 after registration, a combined Section 8 & 9 filing between years 9-10, then Section 8 & 9 every 10 years thereafter. Missing these deadlines can result in cancellation.
A sworn statement that you're still using your trademark in commerce, with specimens showing current use. It's required at years 5-6 and with each 10-year renewal. Failure to file results in cancellation.
You should delete the goods or services you are no longer using. Filing false claims of use can invalidate your entire registration. Be accurate about what you are actually using. Your attorney will help you scope the declaration correctly.
Most jurisdictions offer a 6-month grace period with additional fees. Filing within the standard window is cheaper and safer, so we recommend filing 2-3 months before the deadline.
EUIPO renewals are due every 10 years from the filing date. No proof of use is required for renewal, though marks can be challenged for non-use separately.
After the grace period, the registration is typically cancelled and cannot be restored, and the only route back is a fresh application with a new filing date. Renewing inside the window keeps your original date and the ten-year term running.
Yes. You can selectively renew designations in your international registration, though the fee is for the entire registration. You can also let specific country designations lapse if they're no longer needed.
