Why timing matters
Why Canada renewal timing matters.
Registration-based, no use declaration required at renewal post-2019
Canada moved to 10-year terms (down from 15) in 2019, so any registration granted before mid-2019 may already be in its first shorter renewal cycle. Missing the deadline costs the surcharge or expungement.
Grace period exists, but it costs
CIPO allows 6-month grace period after expiry with surcharge, but the surcharge is real money, and the registration is technically lapsed during that window. Better to file in the standard window.
Missed renewal = lost mark
If the Canada grace period also lapses, the mark is cancelled and the date you lose. Any third party can register the same mark from the day after, including in jurisdictions where squatting is endemic.
