On top of the renewal fee, IP Australia charges $100 for each month, or part of a month, that the fee is late. Renewing 12 days late adds one $100 fee.

My Madrid registration covers Australia. Where do I renew it?

At WIPO, not IP Australia. An international registration renews centrally at WIPO for every country it covers.

Can I renew my Australian trade mark more than a year early?

No. A renewal request can be made at any time in the 12 months before the expiry date. Plan the filing inside that window.

Can I sue a copycat while my Australian mark is expired?

Not for acts in the gap. Section 128 of the Trade Marks Act 1995 blocks infringement actions for acts done after the registration expired and before it was renewed.

Can the six-month late renewal period be extended in Australia?

No. IP Australia's manual says the late renewal period is not extendible. Once it ends, the Registrar removes the mark from the Register.
