Why Australia renewal timing matters.
Registration-based, no use declaration required at renewal
IP Australia is among the more forgiving renewal regimes. There's a generous filing window and a 6-month grace period with a manageable surcharge. Missing both still costs the full new-application fee plus the loss of priority date.
Grace period exists, but it costs
IP Australia allows 6-month grace period after expiry with surcharge, but the surcharge is real money, and the registration is technically lapsed during that window. Better to file in the standard window.
Missed renewal = lost mark
If the Australia grace period also lapses, the mark is cancelled and the date you lose. Any third party can register the same mark from the day after, including in jurisdictions where squatting is endemic.
