Before you file
An earlier identical or similar registered mark covers identical or similar goods. A pre-filing IP India + common-law search catches this before you spend ₹4,500–9,000 per class.
The mark can't function to identify your goods or services as coming from one source. Your advocate argues acquired distinctiveness with use evidence, or refines the goods description.
The mark describes a kind, quality, quantity, intended purpose, or geographical origin. Refusals are appealable to the IPAB / High Court.
Includes deceptive marks, marks against public morality, scandalous matter, and emblems protected under the Emblems and Names Act. We screen for these at intake.
