    Filing in Taiwan

Why filing in Taiwan is different.

The rules that change how we search, draft and file for you. We handle every one of them.

    1

Taiwan is a separate trademark jurisdiction

TIPO operates entirely independently from CNIPA (mainland China). A mainland Chinese registration grants no rights in Taiwan, and vice versa.

    2

Taiwan is not a Madrid Protocol member

You cannot designate Taiwan through a Madrid international application. The only route is a direct national TIPO filing.

    3

    First-to-file with rigorous Traditional-Chinese examination

TIPO conducts examination in Traditional Chinese and applies strict distinctiveness analysis. Traditional Chinese filings matter for consumer recognition.

    4

    Strategic Asian manufacturing hub

Taiwan is a major semiconductor, electronics, and OEM manufacturing centre. Trademark protection here is critical for any brand sourcing from Taiwanese suppliers.

Your attorney runs the check, the drafting and every letter from the TIPO with you, from the first search to the certificate and the renewal ten years on.

    Before you file

Why Taiwan applications get refused, and how the free check helps.

Conflict with an earlier Taiwan mark (Article 30)

    about 30%

An earlier identical or similar TIPO registration covers the same or similar goods. A pre-filing TIPO clearance search catches this before you commit.

    Lack of distinctiveness (Article 29)

    about 25%

The mark is generic, descriptive, or laudatory in Traditional Chinese. Counsel argues acquired distinctiveness or refines the specification.

    Famous-mark conflict (Article 30(1)(11))

    about 14%

The mark causes confusion with a well-known foreign or Taiwanese mark. Taiwan's well-known-mark protection is broad and can cross class boundaries.

    Public-policy or prohibited-sign refusals

    about 8%

Includes marks contrary to public order, state symbols, and protected official insignia. We screen for these at intake.
