Filing in UK
Why filing in UK is different.
The rules that change how we search, draft and file for you. We handle every one of them.
1
EUTMs no longer cover the UK
Existing EUTMs registered before 31 December 2020 were automatically cloned into UK registrations, but every EUTM filed after that date covers only the 27 EU member states. To protect the UK market, you need a separate UKIPO filing.
2
Stop counterfeit imports at UK customs
A registered UK trade mark is the basis for a UK Customs Application for Action, letting Border Force seize counterfeits at every UK port and airport.
3
Madrid Protocol gateway
Use your UKIPO registration as the basing application to extend protection to 130+ Madrid countries in one filing, including the EU as a single Madrid designation.
4
Strong, judge-friendly enforcement
UK courts grant interim injunctions quickly and award costs to the winner. A registered UK mark gives you statutory presumption of validity and access to summary procedures.
Your attorney runs the check, the drafting and every letter from the UKIPO with you, from the first search to the certificate and the renewal ten years on.

Before you file
Why UK applications get refused, and how the free check helps.
Relative grounds, likelihood of confusion (§5(2) Trade Marks Act 1994)
about 30%
An earlier identical or similar UK mark (or earlier EUTM cloned into a UK comparable mark) covers identical or similar goods. A pre-filing UKIPO + UK common-law search catches this before you spend £205.
Devoid of distinctive character (§3(1)(b))
about 22%
The mark cannot identify your goods or services as coming from one undertaking. Counsel argues acquired distinctiveness with use evidence, or refines the specification.
Descriptive or generic (§3(1)(c)–(d))
about 18%
The mark describes a kind, quality, intended purpose, or geographical origin in plain English. UKIPO examiners are strict here. Your attorney drafts to clear this bar.
Public policy, deceptive, or absolute grounds (§3)
about 8%
Includes deceptive marks, marks contrary to public policy, and marks containing protected royal or national symbols. We screen for these at intake.

Foreign applicants (outside the UK, Gibraltar, or Channel Islands) must use a UK address for service, without a UK attorney or agent, the UKIPO will not communicate with you. Every GTC UK trademark application is filed by a UK-qualified trade mark attorney who handles every UKIPO communication on your behalf.
Our attorney fee is $250 for the first class and $80 for each additional class. UKIPO government fees and the processing fee are shown separately in your estimate. Your written quote confirms the total before you accept and pay.
4-6 months in a smooth path: 1-2 months to first examination, 1 month to publication, then a 2-month opposition window, then registration. UKIPO is one of the fastest registries in the world.
If your EUTM was registered before 31 December 2020, you received an automatic cloned UK comparable mark. For EUTMs filed after that date, you need a separate UKIPO application. They don't cover the UK. We file UK and EU in parallel where both are needed.
After examination clears, your UK application is published in the UK Trade Marks Journal. Third parties have 2 months from publication to file a Notice of Opposition (extendable by 1 month). If no opposition is filed, your mark proceeds to registration. If opposition is filed, your attorney guides you through cooling-off, defence, and (if needed) a hearing.
Yes. The UKIPO accepts applications with no proof of use at filing. The mark must be put to genuine use within 5 years of registration, or it becomes vulnerable to revocation for non-use under §46 of the Trade Marks Act 1994.
Yes. UKIPO rules require non-UK-domiciled applicants to provide a UK address for service. We provide the UK address for service and handle every UKIPO letter for you.
UKIPO and UK common-law clearance search, Nice classification, drafting your goods/services description, preparing the TM3 application, filing via the UKIPO online portal, monitoring the 2-month opposition window, and responding to standard non-substantive examiner objections. Substantive refusals and opposition defence are quoted upfront before any work begins.
Since Brexit, the two are completely separate. A UK mark covers England, Wales, Scotland, and Northern Ireland. An EUTM covers the 27 EU member states (no UK). British businesses that sell into Europe need both. We file UK and EUTM in parallel for that scenario.
A UK-experienced attorney reviews your brand, checks the UKIPO's register for conflicts, and maps your fastest route to a registered UK trademark. No payment, no obligation.

† UKIPO filing fees.
The UKIPO charges £205 for the first class on the online TM3 and £60 per additional class, paid directly to the UKIPO. Government fees are subject to scheduled increases by the UKIPO and are passed through at cost. Government fees are non-refundable, even if your application is refused.
§ Procedural examiner responses.
Standard non-substantive examiner objections (clarifications to the specification, classification fixes, formalities) are included. Substantive refusals under §§ 3 or 5 of the Trade Marks Act 1994 and opposition defence are quoted upfront before any work begins.
